中国买家买房告省府这妹子能赢吗

具争议的BC省外国买家税已进入法庭程序，该税的合法性如何，很快就会在法庭上见分晓。

中国留学生李静（Jing Li，音译）因15%外国买家税控告卑诗省政府一案，将在6月下旬至7月中旬举行“即决审判”，审判将对外国买家税是否违法进行裁定，目前正反双方已有大量专家递交书面证词。

2016年8月，BC省政府决定在温哥华地区开征15%的外国买家税，房市随即开始冷却。

政府征收此税的理由，是外国买家的涌入，使当地房价迅速升高，导致当地居民买不起房子。

不过，受到影响的外国买家认为，这外国买家税是非法和歧视性的，已经有外国买家把BC省政府告上法庭。

据《环球邮报》报导，今年6月25日开始，该诉讼的简要审讯（summary trial）将持续一个星期；7月16日将继续审讯。

法官将判断这外国买家税是否合法。

中国买家先出头

媒体聚焦外国买家推高温哥华房价时，最多被提到的是中国买家。现在，这第一宗被媒体聚焦的诉讼，原告也是中国买家。

中国公民李静（Jing Li，音译）是该诉讼的原告。

她在定居BC省本拿比之前，在萨斯喀彻温大学获得学位。根据法庭文件，她在兰利（Langley）以56万元购买了镇屋，外国买家税是8.3万加元。

李静在证词文件中说，她向家人和朋友借钱完成了买房交易，外国买家税让她借债更多。“总的来说，我从这个税和许多公众意见中得到的信息是，我在加拿大不受欢迎”；“我觉得外国买家税给我和很多与我情况相似的人们贴上了不公平的标签，我们成了大温地区房屋负担不起的原因”；“我认为这种愤怒一直针对像我和其他来自亚洲国家的人”。

加拿大政府又没有用枪指着你要你来买房，而且你要是想免交这笔税的话，移民加拿大后再买就是了，而且加拿大的移民打分系统是不分国籍一视同仁的。

请放心。BC 的 15% 现在的20% 外国人买家税，2016年8月21日开征，40天后，9月19日，李静的代理律师已正式将诉状呈交一审。下月开庭。这属集体诉讼。李仅为发起人。如胜诉，所有交了此税的买家都会得到退款。李静律师免费全权独家代理。胜诉的话，代理律师与李一定有胜诉收益协议条款，就会在退款总额的10%以上。起码有几千万的收益。因为，BC 省府到今天这外国买家税已有3亿以上的收入。一般情况，律师只有在胜诉大于败诉，才会采取这种共享收益，自担风险的免费独家代理诉讼案。而此案被告（BC 政府）的一切费用，则是100%纳税人买单... [更多...]

放心，政府不会输的。政府掌握议会，议会有立法权。至于说歧视，外国买家税的对象是所有在加拿大的外国人，怎么没有其他国籍的人抱怨歧视呢？现在只有一个中国人，能代表谁呢？

But the strategy occasionally succeeds and could do away with the entire trial, he said. "If the court sees there's a discrete, clear legal point that could be decided and could dispose of the entire litigation, it may hear that application at an early stage," he said. Rosenberg says this would also disadvantage the foreign buyers when it comes to costs. If the summary trial goes ahead before the class action is certified, he said, the plaintiffs won't be protected from paying costs by B.C.'s no-cost class action regime.
